How to Get VA Disability for Arthritis
Arthritis is a rheumatic condition characterized by inflammation of the joints. This inflammation leads to pain, swelling, and limitation of movement. According to the Centers for Disease Control and Prevention (CDC), nearly 19% of adults in the nation have been diagnosed with arthritis. Still, the condition is significantly more common among veterans, affecting more than 35%.
Like most medical conditions, arthritis may be relatively mild or severe, ranging from occasional painful days to ongoing limitations.
If you’re a military veteran suffering from this condition, here’s what you need to know about eligibility for VA disability benefits. This is just an overview, though. The best source of personalized information and guidance is an experienced VA disability benefits advocate.
Service Connection for Arthritis
To receive VA disability benefits for arthritis or any other medical condition, the veteran must first show that the condition is service connected.
Presumptive Service Connection for Arthritis
Arthritis is a chronic condition listed in 38 C.F.R. §3.309. A veteran suffering from one of these listed conditions is entitled to a presumption that the condition is service-connected if they served for at least 90 days during wartime (after 12/31/46) and their condition manifested to at least a 10% disability within one year of separation from service.
Securing Benefits for Arthritis without a Presumption
If a veteran doesn’t qualify for a presumptive service connection for arthritis, there are still two ways they may be able to secure VA disability benefits for the condition. The first is to establish a service connection by showing that something that occurred during military service caused the arthritis. This will typically require evidence of the incident or work performed that led to the condition, along with a letter from a medical professional connecting that evidence to arthritis.
The other possibility is to show a secondary connection. For example, arthritis can be secondary to a physical injury.
